Uninsured Motorist Coverage Explained — California

California ranks among the top states for uninsured drivers — approximately 16%% of all drivers in the state carry no insurance at all. In the Inland Empire, that rate can be even higher. If you're hit by an uninsured driver, knowing how UM/UIM coverage works can make the difference between recovering your losses and getting nothing.

What Is Uninsured Motorist (UM) Coverage?

Uninsured Motorist (UM) coverage is an optional add-on to your own auto insurance policy. If you're hit by a driver who has no insurance, your UM coverage acts as though their insurance company is paying you — out of your own policy.

What Is Underinsured Motorist (UIM) Coverage?

Underinsured Motorist (UIM) coverage kicks in when the at-fault driver has insurance, but their policy limits are not enough to cover your damages. For example, if your medical bills total $120,000 but the at-fault driver only carries $15,000 in liability coverage, your UIM coverage can pay the remaining $105,000 (up to your policy's UIM limit).

Is UM/UIM Required in California?

California does not require you to carry UM/UIM coverage — but insurance companies are required to offer it to you in writing. If you declined it, you should have a signed waiver in your policy file. Many drivers decline it to save on premiums and later regret it.

Action item: Check your declarations page right now. If you don't see "Uninsured Motorist Bodily Injury" (UMBI) on your policy, call your insurer and add it. It typically costs only $10–$30 extra per month.

How UM/UIM Claims Work

  1. Report the accident to your own insurance company promptly — most policies require "prompt notice."
  2. File a UM claim with your own insurer. Despite what you might think, you are making a claim against your own policy — not suing someone else.
  3. Your insurer takes the role of the at-fault driver's insurer — which means they will investigate the claim and may dispute liability or damages.
  4. Negotiation or arbitration — most UM claims are resolved through negotiation. If you can't agree, many policies require binding arbitration rather than litigation.

Hit-and-Run Accidents

If you're hit by a driver who flees the scene and is never identified, your UM coverage typically covers you — as long as there was physical contact between the vehicles. California requires physical contact for a UM hit-and-run claim (you cannot typically file a UM claim for a "phantom vehicle" that caused you to swerve without contact).

Important: Do not give a recorded statement to your own insurance company's UM adjuster without first speaking to an attorney. Even your own insurer can use your statements to minimize your claim.

What Damages Does UM/UIM Cover?

UM/UIM Stacking in California

If you own multiple vehicles and each has UM coverage, California generally does not allow you to "stack" those limits unless your policy explicitly permits it. However, if you're injured while a passenger in someone else's car, you may be able to claim against both the host vehicle's UIM policy and your own — this is called "inter-policy stacking" and is sometimes permitted.
